Terms of Service

Welcome to TwoFishTwoCats. These Terms of Service ("Terms") govern your use of the TwoFishTwoCats mobile application ("the app," "our app") and related website. By creating an account or using the app, you agree to these Terms. If you do not agree, please do not use the app.

1. Eligibility

You must be at least 13 years of age to create an account and use TwoFishTwoCats. If you are between 13 and 18, you must have permission from a parent or legal guardian. By using the app, you represent that you meet these requirements.

2. Your Account

• You are responsible for maintaining the security of your account credentials
• You are responsible for all activity that occurs under your account
• You must provide accurate information when creating your account
• You may not create accounts for the purpose of impersonating another person
• You may delete your account at any time using the "Delete Account" option in the app, which permanently removes your data from our servers

3. Households & Shared Data

TwoFishTwoCats allows you to create or join a household with other users. When you participate in a household:

• Content you create (todos, events, meals, shopping lists, notes, workouts, mood entries, and pet health data) is visible to all adult members of your household
• Other household members may edit or delete shared content
• Dependent profiles (children, pets) you add are visible to all adults in the household
• If you leave or delete your account, content you created will be removed

You are responsible for only sharing information you are comfortable making visible to your household members. Each household's data is isolated and is not accessible by members of other households.

4. Acceptable Use

You agree not to:

• Use the app for any unlawful purpose or in violation of any applicable law
• Attempt to gain unauthorized access to the app, other users' accounts, or our infrastructure
• Interfere with or disrupt the app's services, servers, or networks
• Reverse-engineer, decompile, or disassemble the app
• Use automated scripts, bots, or scrapers to access the app
• Upload or transmit malicious code, viruses, or harmful content
• Use the app to harass, abuse, or harm another person
• Circumvent any rate limits, security features, or access controls

We reserve the right to suspend or terminate accounts that violate these terms or engage in abusive behavior.

5. Your Content

You retain ownership of all content you create within the app (todos, events, notes, meal plans, etc.). By using the app, you grant TwoFishTwoCats a limited license to store, process, and display your content solely for the purpose of providing the app's functionality to you and your household members.

We do not claim ownership of your content. We do not use your content for advertising, marketing, training data, or any purpose other than delivering the app's features.

6. The App & Service Availability

TwoFishTwoCats is provided on an "as is" and "as available" basis.

While we strive to keep the app running reliably, we do not guarantee:

• Uninterrupted or error-free operation
• That the app will meet all of your requirements
• The accuracy or reliability of any third-party data (such as weather information or recipe suggestions)
• That data will never be lost (we recommend keeping important information in additional locations)

We may update, modify, or discontinue features of the app at any time. We will make reasonable efforts to notify users of significant changes.

7. Third-Party Services

The app integrates with third-party services to provide certain features:

• Firebase (Google) — for authentication, data storage, and cloud functions
• OpenWeather — for weather data
• TheMealDB — for recipe suggestions

These services are subject to their own terms and privacy policies. We are not responsible for the availability, accuracy, or conduct of third-party services. If a third-party service becomes unavailable, the corresponding feature in the app may be temporarily unavailable.

8. Pricing

TwoFishTwoCats is currently free to use with no advertisements and no subscription fees. If we introduce paid features in the future, they will be clearly presented as optional, and existing free functionality will not be removed or restricted behind a paywall without advance notice.

9. Limitation of Liability

To the maximum extent permitted by applicable law, TwoFishTwoCats and its developers shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

• Loss of data or content
• Loss of profits or revenue
• Service interruptions or downtime
• Errors in third-party data (weather, recipes, etc.)
• Unauthorized access to your account due to compromised credentials

10. Indemnification

You agree to indemnify and hold harmless TwoFishTwoCats and its developers from any claims, damages, losses, or expenses (including reasonable attorney fees) arising from your use of the app, your violation of these Terms, or your violation of any rights of another person or entity.

11. Intellectual Property

The TwoFishTwoCats name, logo, visual design, and original code are the intellectual property of TwoFishTwoCats. You may not use our branding, trademarks, or design elements without prior written permission.

The app uses open-source libraries and third-party services, each subject to their respective licenses.

12. Termination

• By you: You may stop using the app and delete your account at any time. Account deletion permanently removes your data from our servers.
• By us: We may suspend or terminate your access if you violate these Terms, engage in abusive behavior, or if we discontinue the service. If we terminate your access without cause, we will make reasonable efforts to allow you to export or delete your data first.

13. Dispute Resolution

If a dispute arises from your use of TwoFishTwoCats, we encourage you to contact us first at support@twofishtwocats.com so we can attempt to resolve it informally.

If informal resolution is not possible, any disputes shall be resolved through binding arbitration conducted in accordance with the rules of the American Arbitration Association (AAA), rather than in court. You agree that any arbitration will be conducted on an individual basis and not as a class action.

30-Day Opt-Out: You may opt out of this arbitration agreement by sending written notice to support@twofishtwocats.com within 30 days of first accepting these Terms. Your notice must include your name, email address, and a clear statement that you wish to opt out of the arbitration clause. If you opt out, you may pursue claims in court instead.

Exceptions: Either party may bring claims in small claims court if eligible. Nothing in this section prevents either party from seeking injunctive relief in court for intellectual property infringement or unauthorized access.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of California and the applicable federal laws of the United States, without regard to conflict of law principles.

15. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.

16. Force Majeure

We shall not be liable for any failure or delay in performing our obligations under these Terms where such failure or delay results from circumstances beyond our reasonable control, including but not limited to natural disasters, acts of government, internet or infrastructure failures, or third-party service outages.

17. Entire Agreement & Waiver

These Terms, together with our Privacy Policy, constitute the entire agreement between you and TwoFishTwoCats regarding the use of the app. They supersede all prior agreements, representations, and understandings.

Our failure to enforce any right or provision of these Terms shall not be considered a waiver of that right or provision. A waiver of any term shall not be deemed a further or continuing waiver of such term or any other term.

18. Changes to These Terms

We may update these Terms from time to time. When we make changes, we will update the effective date at the top of this page. For significant changes, we will make reasonable efforts to notify you (such as through the app or by email).

Continued use of the app after changes take effect constitutes acceptance of the updated Terms. If you do not agree with the changes, you should stop using the app and delete your account.
